$460,000 FORFEITED. OVER $1 MILLION RELEASED. SO WHERE IS THE "DRUG CONVICTION"?

Putting the allegations to rest

Let’s separate court records from political storytelling.

The allegation against President Bola Ahmed Tinubu is often presented as though he was arrested, prosecuted, convicted and sentenced for drug trafficking in the United States.

That is not what the 1993 court record shows.

The case was a civil asset-forfeiture proceeding, not a criminal prosecution against Tinubu. There was no criminal trial in which Tinubu was convicted of drug trafficking. Even fact-checking of the actual U.S. documents confirms that the records do not show that Tinubu was indicted or convicted.

Here is where the story gets interesting.

The U.S. government seized funds in accounts connected to Tinubu and others and alleged that the money was connected to narcotics trafficking or money laundering.

Tinubu and the other claimants disputed the government's position, and the matter was ultimately resolved through a stipulated compromise settlement before Judge John A. Nordberg.

Under that settlement:

$460,000 was forfeited to the United States.

But the court simultaneously ordered that the remaining funds in the Heritage account and the funds held at Citibank be released to the claimants, with the Citibank action dismissed with prejudice.

So ask the obvious question:

If the entire fortune had been judicially established as criminal proceeds, why did the U.S. government release the rest of the money under a court-approved settlement?

The answer is important: a civil forfeiture of specific funds is not the same thing as a criminal conviction of the person whose name appeared on an account.

And that distinction matters.

The court's forfeiture order concerned $460,000 in a specific First Heritage Bank account. It did not sentence Tinubu to prison. It did not convict him of narcotics trafficking. It did not impose a criminal fine on him. The proceeding was against the property, under U.S. civil-forfeiture law.

So when someone says:

“Tinubu was convicted of drug trafficking in America.”

Ask them:

Where is the criminal conviction?

Where is the criminal sentence?

Where is the indictment?

Because the documented 1993 proceeding was a civil forfeiture case resolved by settlement, not a criminal conviction.

You can debate the allegations. You can debate the $460,000 forfeiture. You can debate the politics.

But don't rewrite a 1993 civil settlement into a criminal conviction that the court records do not show.

THE FACTS ARE MORE COMPLICATED THAN THE CAMPAIGN SLOGAN.

$460,000 was forfeited. Other funds were released. The case was settled. And there was no criminal conviction of Bola Tinubu for narcotics trafficking in that proceeding.

That's the record.
